EFF turns to ConCourt regarding Parliament’s Phala Phala decision

The Economic Freedom Fighters (EFF) has turned to the Constitutional Court for direct access. This in a bid to challenge Parliament’s December 2022 decision to not adopt the Section 89 independent panel report into Phala Phala and not refer it to the impeachment committee.

In papers, the EFF wants that decision to be declared irrational and unlawful. The party argues that the National Assembly acted irrationally by “blocking” the further investigation of a prima facie case against the President despite the findings of the panel report.

The party further submits in papers that the National Assembly had failed to consider the content of the panel report.

The said panel report into the robbery of alleged foreign currency at the President’s Limpopo farm rocked the nation after its finding that the President “may have a case to answer”.

However, on the 13th of December 2022, the National Assembly decided to reject the motion to refer the panel report to an impeachment committee.

Following this decision, the President, under those circumstances, decided to no longer pursue a legal review of the panel report.
