The Economic Freedom Fighters (EFF) in the Free State has voiced concerns over the alleged compromise of judicial independence within the province.
The party claims that a significant number of magistrates in the Free State have been serving as acting magistrates for the past two years, raising questions about their ability to make impartial rulings.
EFF provincial secretary, Malefane Msimanga expresses apprehension that magistrates in acting roles might be reluctant to issue independent judgments, fearing repercussions on the renewal of their contracts.
Msimanga asserts that the provincial government’s control over the judiciary system poses a threat to the autonomy required for a fair and just legal system.
According to Msimanga, the African National Congress (ANC) government is attempting to manipulate systems to safeguard individuals with political influence, hindering the judiciary’s ability to function independently.
The EFF has urged the judiciary to appoint magistrates on stable contracts, emphasising the importance of affirming the independence of the judiciary in the Free State.
