N West court decision a game changer: Analyst

Political Analyst from North West University, Professor Andre Duvenhage says the decision by the North West high court is a game changer as far as Nkosazana Dlamini Zuma and Cyril Ramaphosa campaign are concerned in the province.

Judge President Monica Leeuw declared African National Congress Bojanala regional conference invalid when handing down the judgement.

Tokyo Mataboge and 39 others wanted the court to set aside the outcome of the ANC’s September regional elective conference.

Part of their argument was that if the outcome were not set aside illegitimate delegates would be attending the national elective conference which starts at Nasrec in Johannesburg on Saturday.

The regional conference held on the 24th September 2017 the decisions taken at such conference are irregular, unlawful and unconstitutional and consequently reviewed and set aside.”

“The orders in paragraph one to five above do not affect the rights of the delegates who have been elected at properly branch general meetings in Bojanala regions they have as delegates at any other conference of the African National Conference ,7 there is no order as to costs.”

That was Judge President Monica Leeuw handing down the judgement in a full bench sitting of judges in North West High Court in Mahikeng.

Disgruntled members were arguing that illegitimate delegates from about 40 of the 154 branches in Bojanala which includes Madibeng, Rustenburg, and Moses Kotane were not supposed to attend the conference.

However the applicant’s spokesperson Gabriel Nkgweng says, though they emerged victorious in the matter, what they were pursuing in this matter in line with the constitution of the organisation.

“At least at the end of the day the court was able to provide that leadership, the one that was supposed to be provided by our leadership in the province and they failed to do that, this is just a tip of an eyes bag.”

“If you can go across the province you will identify so many challenges as a result of kind of leadership we have in the province. So the ANC itself need to come up very clear  making sure that how does it assist the general membership in dealing with particular challenges that affects this particular province.”

However, ANC in the province says, it will appeal the judgement.

ANC Chairperson Supra Mahumapelo says:”This was an action against the nomination processes against the regional conference which took place sometime back which is September, it has nothing to do with the national conference because the processes of the national conference took place after the nomination of the regional conference .”

Political Analysts Professor Andre Duvenhage  says:”That will differently be negative for the Zuma camp and I am picking up that there is a lot of momentum behind the Cyril Ramaphosa group but when I look at the Nkosazana Dlamini Zuma camp I am seeing a lot of challenges among them.”

Meanwhile, Secretary-General, Gwede Mantashe says the court ruling won’t negatively affect tomorrow’s conference.
