The South African Human Rights Commission’s case against Economic Freedom Fighters’ (EFF) leader, Julius Malema, regarding his withdrawal of and apology for statements that amount to hate speech, begins tomorrow in the Equality Court in Cape Town.
The case stems from complaints that AfriForum and its members submitted to the commission in October 2022 following Malema’s statements during the EFF’s provincial meeting in the Western Cape.
The commission found that Malema and the EFF’s statements did amount to hate speech and incitement to violence.
The commission demanded that Malema retract his statements and apologise within ten days.
However, Malema refused.
The SAHRC has now turned to the Equality Court to obtain an interim interdict.
AfriForum’s Ernst van Zyl says the commission must act consistently against politicians who incite violence.
