Hlophe does not want any of the judges in the Gauteng Division to hear his case

Western Cape Judge President John Hlophe says he does not want any of the judges in the Gauteng Division to hear his case. Judge President Dunstan Mlambo heads two High Court divisions in Johannesburg and Pretoria.

Hlophe is challenging the Judicial Services Commission’s decision related to his impeachment.

Hlophe has requested that his matter should be heard by a judge in a different division and not the one in Gauteng under Mlambo.

He argues that Judge President Mlambo is implicated in his review application and therefore he does not believe that this will result in any of the judges in Mlambo’s division being impartial.

In his court papers, Hlophe argues that the four JSC members – including Mlambo were automatically disqualified from participating at the JCS’s meeting of the 25th August last month which endorsed the finding of the Judicial Conduct Tribunal that he should be impeached.

In April, the Judicial Conduct Tribunal found Hlophe guilty of trying to influence two Constitutional Court Justices, Chris Jafta and Bess Nkabinde, in a matter involving then former President Jacob Zuma in 2008.
