Heath’s lawyers to seek leave to appeal

Lawyers representing former judge Willem Heath say they will seek leave to appeal the decision of the High Court in the Western Cape dismissing his application to set aside former president Thabo Mbeki’s decision to decline his request for a discharge from active services.

Heath says this forced him to resign, losing all his benefits.

His lawyer Barnabas Xulu says they will approach the Supreme Court of Appeal because they believe the court judgment has missed a very important constitutional point affecting judges.

“It’s a constitutional matter too. It is about the constitution of this country and the interaction between the executive, in particular the President and  judges, how the President was supposed to have handled the matter in a very important critical point that is supposed to be decided by the court.”
