The South African Broadcasting Corporation (SABC) has welcomed Thursday’s decision by the High Court in Johannesburg, striking off from the roll an urgent application brought by Michael Owen Production, citing lack of urgency.

The production company has been ordered to pay the legal costs of the SABC on an attorney and clients scale, including costs of counsel.

The court order follows an urgent application brought by Owen Ndlovu of Michael Owen Production earlier today to interdict the public broadcaster from airing promotions and announcing the winner or results or poll promotions relating to Ukhozi FM’s ‘Ingoma Ehlukanisa Unyaka’ or New Year’s Eve Song of the Year Competition.

“The SABC is also pleased that the court order removes any confusion that may have been occasioned by the application and re-iterates the SABC‘s position that the co-operation was within its rights to continue implementing Ukhozi FM’s Ingoma Ehlukaninsa Unyaka campaign which has been running over the years on the station,” says Acting SABC Spokesperson is Mmoni Seapolelo.

Owen Ndlovu explains the dispute:

Some of the songs featured on this year’s list include among other  Kelly Kumalo’s Empini, Azana’s Your Love, Big Zulu’s Mali Eningi, DJ Hlo’s Festive.
