Former Nelson Mandela Bay African National Congress (ANC) councillor Andile Lungisa says he is appealing his two-year imprisonment sentence in the Constitutional Court.
He was released on parole on Tuesday, two-and-a-half months after beginning a two-year prison sentence for smashing a water jug over the head of DA councillor Rayno Kayser.
However, Lungisa is adamant that he acted in self-defence as he was attacked first.
“We are appealing in the Constitutional Court as I’m talking to you, we [are] waiting for the ConCourt to adjudicate on that matter. I will never take responsibility for a matter of when I was attacked.”
“That was the classical self-defence. Investigative journalists you can check the video portion by portion, you [will] see I was attacked five times before I defended myself. Indeed an innocent man was taken to prison,” explains Lungisa.

Meanwhile, Correctional Services spokesperson Singabakho Nxumalo says Lungisa is expected to comply with a specific set of parole conditions and will be subjected to supervision until the sentence expires.
In October, the Department of Correctional Services described as ‘unfounded’ reports that Lungisa will be released on parole on December 1.
On Monday, the Free Lungisa Campaign expressed their optimism over the parole, saying that are ready and eager to welcome him back into society.
Lungisa has been released among a group of prisoners to decrease the number of inmates amid the coronavirus pandemic.
