The Supreme Court of Appeal in Bloemfontein has dismissed Nigerian pastor Timothy Omotoso’s application to have Judge Mandela Makaula of the High Court in Port Elizabeth recuse himself from his case.
Omotoso and two co-accused are facing numerous charges, ranging from sexual assault, rape and trafficking for sexual purposes to racketeering.

Their case will be back in the High Court on 4 February next year.
National Prosecuting Authority spokesperson, Tsepo Ndwalaza, says that the NPA is happy with the court’s decision.
“As the NPA we can confirm that the indeed the SCA dismissed the application of Omotoso’s defence lawyers to have the judge recused and charged quashed. We are therefore very happy that this has happened. This puts us back in the driver seat and we can go ahead with the case and proceed as planned.”
