Legal expert Abigail Ngubane says the court has to consider several factors in the bail application of the five accused in the Kiernan ‘AKA’ Forbes murder trial.

Forbes and Tebello ‘Tibz’ Motsoane were gunned down outside a Durban restaurant in February last year.

Five suspects are launching their bail applications in the Durban Magistrate’s Court today. They are facing charges of murder, attempted murder, illegal possession of firearms and ammunition, and money laundering.

“The judge would consider the interest of justice versus the exceptional circumstances in which they will have a duty in terms of the owners of the court. So when we entirely evaluate the evidence that is before the court, the likelihood of them getting bail at this stage is very slim. Given the fact that there is a charge of conspiracy to commit murder. And in that charge, it symbolises that there was coordination between all of them. There was a doctrine of common purpose, they worked together jointly,” Ngubane elaborates.
