The High Court in Gqeberha in the Eastern Cape has dismissed self-proclaimed pastor Timothy Omotoso’s application to reconsider Judge Irma Schoeman’s judgment against the withdrawal of charges against him and two accused.
In his application, defence advocate Peter Dauberman said that the former state prosecutor, Nceba Ntelwa, had incited certain witnesses to commit perjury.
This comes after Omotoso’s brief appearance in court this morning.
Passing her judgment, Judge Schoeman told the court that she had already dismissed charges where no witnesses had been called and where Melucia Jiyane, a witness said to have committed perjury, had been a witness.
Schoeman said Jiyane had already given different versions of events in her statements and could not find that Ntelwa had suborned her to commit perjury.
Schoeman further stated that there had been no failure of disclosure from the court, as a WhatsApp group had been created by Ntelwa prior to the commencement of the trial and had been disbanded by the time the trial commenced. Schoeman also told the court that even though Ntelwa’s conduct had been unprofessional, it had no impact on the current proceedings.
The court case has been postponed to June 24.
