Court to rule over Kenyan re-elections

The Supreme Court in Kenya will on Monday give its ruling on two petitions filed to challenge President Uhuru Kenyatta’s re-election last month.

The court nullified Kenyatta’s August victory and ordered fresh elections over irregularities by the electoral commission. The petitions have been filed by a former Member of Parliament and two human rights activists.

The six-judge bench will rule on whether to uphold Kenyatta’s re-election paving the way for Kenyatta’s swearing in for a second and final term or nullify the results and order for fresh elections.

The court in its ruling will determine whether the Independent Electoral and Boundaries Commission should have ordered for fresh nominations for presidential candidates to vie in the October 26 polls and whether the withdrawal of the National Super Alliance (NASA) from the race should have prompted the cancellation of the elections altogether.

It will also determine whether violence in 25 constituencies, which did not vote during last month’s elections, affected the outcome of the polls. President Kenyatta won the elections with 98% of the votes cast after the opposition candidate Raila Odinga withdrew from the race over claims that the electoral commission was biased.
