Judge Makhubele’s legal team seeks hearing postponement

The legal counsel for Judge Nana Makhubele has requested a postponement of the Gauteng High Court Judge’s appearance before the Judicial Conduct Tribunal. The hearing was meant to be held this week after a postponement in November last year.

The basis for the postponement sought in 2023 was the tariffs on her legal fees which the State Attorney and her legal representation are not in agreement on. However, the postponement sought before the panel led by retired Judge President Achmat Jappie on Monday was, among other things, the consultation that needed to take place between Makhubele and her legal counsel Advocate Vincent Maleka (SC).

Maleka requested a postponement to the end of February.

Makhubele is appearing before the Tribunal after a complaint lodged by organisation, hashtag Unite Behind to the JSC of misconduct accusing her of breaching the separation of powers principle by being a Judge of the Gauteng High Court and Chairperson of PRASA’s interim board.

Maleka makes this plea before the Tribunal. “We made it quite clear that for us to properly represent her and assist the tribunal, we will need time to look at the material that we previously worked with. We would also have to look at the transcript of the evidence that captures the evidence previously presented by a number of witnesses.”

“We will also need time to consult with her. We have also made it quite clear to judge Makhubele. We have not reserved ourselves for this week in order to continue with our representation for her,” Maleka adds.
