Suspended head of the Gauteng Health Department, Dr Barney Selebano, has launched an urgent application for leave to appeal the High Court’s judgment which dismissed his application to have his subpoena to testify at the Esidimeni hearings, set aside.
Selebano told the South Gauteng High Court in Johannesburg through his lawyers that he believes there’s a reasonable prospect that a different court might come to a different conclusion.
He was due to start testifying at the Arbitration hearing, sitting in Parktown north of Johannesburg.
Selebano was expected to give an account of his role in the relocation of mentally ill patients and subsequent deaths of 143 of them.
