Defacing of party posters a criminal offence: IEC

People who deface election party posters could face a sentence of five to 10 years imprisonment. This is according to Electoral Commission’s (IEC) Chief Electoral Officer Sy Mamabolo.

It comes in response to the vandalism of party posters ahead of the May 8 elections.

Some posters bearing the face of African National Congress (ANC) president Cyril Ramaphosa, the Freedom Front Plus, Economic Freedom Fighters (EFF) and United Democratic Movement (UDM) have been vandalised in some areas in Cape Town.

The defacing of party posters has also been seen in other parts of the country. Mamabolo says it is a serious offence.

“Defacing of a poster of a party participating in the elections is a criminal offence. And it’s also against the provisions the electoral code of conduct.”

“So if you are found, you will be prosecuted in the courts and upon conviction you will be liable to a sentence of between five to 10 years.”

“But additionally, should this be happening at the instance of a party, that party can be referred to the electoral court for prosecution.”
