Widespread municipal by-election set for Wednesday

The largest by-election window since the 2016 Local Government Elections is taking place across South Africa on Wednesday, according to the Independent Electoral Commission.

A statement released by the IEC indicates that “the by-elections will be contested by hundred and five (105) candidates from fifteen (15) political parties and five (5) independent candidates.”

The Municipal Structures Act of 1998 specifies that by-elections can occur in a number of permutations, namely:
• Whenever a councillor dies;
• resigns from the party;
• resigns from the council;
• is expelled from his/ her party or
• is expelled from the council

The legislation also outlines that by-elections can occur when the IEC does not declare the results of an election or when a court sets aside the election of a council or ward and when a council is dissolved.
