The Constitutional Court is hearing arguments into why National Director of Public Prosecutions Shaun Abrahams cannot continue to hold office.

The case has been brought by lobby groups, Council for the Advancement of the South African Constitution and others. The applicants seek a confirmation of an earlier judgment by the High Court in Pretoria which set aside Abrahams’ appointment as prosecutions boss.

This is after it found that the settlement agreement entered into by Former NPA head Mxolisi Nxasana , the President and the Minister of Justice was unconstitutional.
