State asks court to dismiss mistrial application in Omotoso case

The case against rape accused Pastor Timothy Omotoso and his two co-accused, Zukiswa Sitho and Lusanda Sulani,  has been remanded until the 4th of October in Gqeberha.

This is to give Judge Irma Schoeman enough time to go through the material in both of the arguments brought forward by the prosecution and defence.

On Friday, State advocate Chris Mouton asked the Judge to dismiss the application. He stated that none of the evidence brought forward by the defence warrants a mistrial.

Advocate Chris Mouton has told the court that the evidence presented by the defence does not prove that the accused faced an unfair trial, and does not warrant a mistrial.

He continued saying that the defence is merely trying to discredit the evidence of the witnesses so that they can use that as proof that the accused has not had a fair trial. Mouton ended his argument by asking Judge Irma Schoeman to dismiss the mistrial application.

Defence lawyer Peter Daubermann immediately fired back, once again emphasising the lack of creditability in the witness statements due to its many inconsistencies.
