Parliament committee says no legal basis to halt impeachment process of Mkhwebane

Parliament’s legal services office says there is no legal basis to halt the process to impeach Public Protector Busisiwe Mkhwebane at this stage. This follows a letter from Mkhwebane’s lawyers informing the Speaker that she intends to file a recession application in the Constitutional Court regarding the Parliamentary inquiry into her fitness to hold office. She has asked that the impeachment process therefore should be halted.
The Parliamentary committee into section 194 of the Constitution resumed its work after it was halted pending previous legal challenges.
“About over an hour ago we received another response from them which basically persists. There is nothing before us other than an intention to do so. So there is no legal impediment from the work of the committee,” says Advocate Siviwe Njikela from Parliament’s legal services.
