The case of Pastor Paseka “Mboro” Motsoeneng and his co-accused has been postponed to 11 November at the Palm Ridge Magistrate’s Court on Gauteng’s East Rand.
The trio were arrested in August this year after a viral video showed them storming at a school in Katlehong, wielding pangas.
Magistrate Ipfi Mammburu dismissed the state’s application to amend Motsoeneng’s bail conditions.
This is after the state submitted an affidavit in which Margaret Malaza, the maternal grandmother of the two children that were forcibly removed from school by Motsoeneng, told the court that she feels threatened because Motsoeneng mentioned her during media interviews as the person who burnt his church.
The state had argued for additional bail conditions to be put in place against Motsoeneng.
But Mammburu dismissed the state’s application.
“After listening to the state and the incorrect assumptions the matter is broad under Section 64 c, I am not convinced that at this stage the court should temper or interfere with the conditions. Because the inference to withdraw can be more than one, it could be another Malaza that burnt down the church as long as there was no mention of either the name or initial. I am satisfied that there are no violations of the bail conditions at this stage.”
