Former Public Protector Advocate Thuli Madonsela has welcomed the decision by the High Court in Pretoria to dismiss President Jacob Zuma’s application to review the public protector’s remedial action on the state of capture report.

The full bench led by Judge President Dunstan Mlambo unanimously dismissed Zuma’s application to review the remedial action that the chief justice appoints a judge to head up a state capture inquiry set aside and declared unconstitutional.

Madonsela says the failure to investigate the state capture allegations will lead to a cold case which will be detrimental to its investigations.

The court also ruled that the inquiry into state capture should have the same investigative powers as the Public Protector.

This is the second ruling by the same court in a few days that bars President Zuma from making a senior appointment.

Last week, the court ruled that Zuma could not appoint a new National Director of Public Prosecutions, while setting aside Zuma’s appointment of Shauna Abrahams as National Prosecuting Authority (NPA) chief.

The President, the NPA and Abrahams all plan to appeal that judgment.
