The kingship of amaMpondo ase Qaukeni is in the spotlight in the Constitutional Court.

Wezizwe feziwe Sigcau is arguing that she is the rightful heir to the throne not Zanuzoko Sigcau as the Commission on Traditional Leadership Disputes and Claims found.

Advocate Patrick Mtshaulana is arguing that former pesident Jacob Zuma should have consulted the royal family before issuing a certificate of recognition in favour of Zanuzoko.

Feziwe is arguing that the royal family has recognised her.

Matshaulana argues that the State’s role is to recognise and not appoint a traditional leader.

“We understand Section 21 of this act and the constitution to be saying we don’t give the State the power to decide who the traditional leader is whether that State is governor or the commission. The decision is according to customary law, the commission has been brought into existence for purposes of helping dispute resolutions and if you look at the new act you see that although the commission has been created, its decisions are not final.”
