Justice Sutherland orders Part B of Hlophe’s review application be removed from court roll

Gauteng Division Deputy Judge President Roland Sutherland has ordered that Part B of Western Cape Judge President John Hlophe’s review application will be removed from the court roll today. This is to allow legal representatives to exchange court papers that must be submitted to his office.

Freedom Under Law has requested to join the proceedings as a friend of the court. Hlophe wants among other things, the court to set aside the report of the Judicial Conduct Tribunal which found him guilty of gross misconduct. This after he allegedly tried to influence two Constitutional Court Justices Chris Jafta and Bess Nkabinde in a matter involving then ANC president Jacob Zuma in 2008. Justice Sutherland elaborates on the way forward when he made an order.

“With regards Part B the matter will be removed from the roll today for the purposes of 1. – the representatives of the applicant and the Judicial Service Commission and the Freedom Under Law to exchange with one another to prepare a sensible timetable for the exchange of affidavits and heads of arguments. Once an agreement has been reached on the timetable, the office of the Deputy Judge President in Johannesburg should be e-mailed with the details where-upon number 2. -I shall fix the earliest convenient date to hear the matter.”
