Judgment to be handed down in the Mandela home dispute

The Supreme Court of Appeal in Bloemfontein will on Friday hand down judgment in the Mandela home ownership dispute.

Struggle stalwart Winnie Madikizela-Mandella, who is Nelson Mandela’s ex-wife, argued that the High Court in Mthatha has ignored overwhelming evidence at its disposal when it dismissed her application in April 2016.

The property was bequeathed to the Nelson Rholihlahla Mandela Family Trust by the late former President, for the benefit of the Mandela family.

Madikizela-Mandela has argued that the then Land Affairs Minister Derek Hanekom did not consult before donating the land to Nelson Mandela in November 1997.

The disposal of the property happened even though their civil divorce took place in 1996. The executors of Nelson Mandela’s estate have hit back.

They’ve argued that Mandela’s will does not deprive Madikizela-Mandela of her informal rights to the property.

It simply states that the property should be administered by the Family Trust.
