The Section 89 Impeachment Committee has voted in favour of opposing the applications filed in the Western Cape High Court asking the court to declare unlawful and set aside its earlier decision to rescind the name of Adv Thandazani Madonsela as its evidence leader.

The decision was supported by 19 members against nine.

The EFF as well as the African Legal Professionals Association (ALPA) are challenging the Impeachment Committee’s decision to rescind Adv Madonsela.

Earlier, President Cyril Ramaphosa wrote to Parliament raising his reservations about Madonsela in terms of two instances of conflict of interest.

He said he removed Madonsela as an appointee to the Judicial Service Commission (JSC) shortly after the 2022 interviews for the appointment of the Chief Justice and therefore, there is a reasonable apprehension that he may harbour a sense of grievance towards him.

His second reservation relates to public comments that Madonsela made with regard to the Phala Phala theft during an engagement with an ANC study group.
