High Court suspends implementation of Public Protector’s remedial action in matter involving Premier Mabuyane, MEC Madikizela

The High Court in Bhisho, in the Eastern Cape, has suspended the implementation of Public Protector Busisiwe Mkhwebane’s remedial action in the matter involving Premier, Oscar Mabuyane and Public Works MEC, Babalo Madikizela.

This is pending the second part of the judicial review.

The court has also granted that an application for the judicial review to be heard on an urgent basis.

This is after Madikizela and Mabuyane approached the court to set aside the remedial action first and then to take the report on judicial review.

Report details

Mkwebane’s report implicates the two and the Eastern Cape African National Congress (ANC) in unduly benefitting from money meant for the memorial service of struggle stalwart, Winnie Madikizela-Mandela in 2018.

Mabuyane has since argued that he has no case to answer, as there are no specific charges against him.

He is also questioning why he’s being subjected to probing by Hawks officials from the Free State.

Mabuyane also accused the Public Protector of not following proper procedures in tabling her report.
