The Supreme Court of Appeal (SCA) in Bloemfontein will on Tuesday hear the government’s argument on a ruling of the High Court in Pretoria to ease access to the R 370 Social Relief of Distress (SRD) grant.
In January last year, the High Court found that key aspects of the grant system were unlawful because they were designed to exclude millions of eligible applicants.
The Institute for Economic Justice (IEJ) and #PayTheGrants brought the lawsuit, and the Socio-Economic Rights Institute of South Africa (SERI) represented them.
The government is also challenging findings related to the adequacy of the R 370 monthly grant and the R 624 means test threshold.
The litigants say they have failed to keep pace with the rising cost of living.
