The Grahamstown High Court will on Monday hear the application filed by 11 African National Congress (ANC) members challenging the outcome of the ANC Eastern Cape elective conference in East London held in October.
The applicants are challenging the legitimacy of the Provincial Executive Committee led by Oscar Mabuyane arguing they were elected without a quorum and correct credentials. The disgruntled members say they were elected after many delegates walked out following the violence that broke out in the conference centre.
In the last court sitting, ANC lawyer Advocate Tembeka Ngcukaitobi submitted a letter written to the ANC Top Six allegedly signed by the applicants withdrawing the matter. Amongst reasons they allegedly advanced is that they want to exhaust the internal processes and the party is committed to resolve the issue.
But Advocate Mvuzo Notyesi has dismissed the letter as a fraudulent act, emphatically denying it was written by his applicants. On Monday, Notyesi will file opposing affidavits saying the applicants know nothing about the letter.
