TERMS AND CONDITIONS OF SERVICE
- The main objective of the South African Broadcasting Corporation SOC Limited (“SABC”) is to inform, educate and entertain members of the public through broadcasting services in the Republic of South Africa as set out in the Broadcasting Act No. 4 of 1999, as amended (“Broadcasting Act”). The SABC, as a national public broadcaster, broadcasts its services through 19 (Nineteen) radio stations and 6 (Six) television channels, via analogue and digital platforms.
- These Terms and Conditions of Service as well as the Privacy Policy are applicable to SABC News, a public broadcast radio station operating under a sound broadcast license granted to the SABC by the Independent Communications Authority of South Africa (“ICASA”). These Terms and Conditions of Service, as well as the Privacy Policy, shall govern the relationship between SABC News and the User and/or Subscriber of our service/s. The User and/or Subscriber is only authorized to use the services or content if they agree to the Term and Conditions herein.
- It is the duty of the User and/or Subscriber to familiarize themselves with the Terms and Conditions of Service and the User and/or Subscriber shall be deemed to be bound by the Terms and Conditions of Service as well as the Privacy Policy by using the services and content. Please be advised that we reserve the right to decide who registers for our services and are not obliged to furnish you with reasons as to why we have declined you access to our services.
- The User and/or Subscriber is only permitted to use the service for personal and non-commercial use. The User and /or Subscriber is duly granted a non-transferable and non-exclusive right to access our services and content.
- The User and/or Subscriber grants permission to the SABC’s Digital Services (Website and Mobile Application) for their content to be used on any of the SABC’s official platforms. The SABC will not claim ownership of such content if it has no written consent or permission from the User.
- The use of our services must strictly be in accordance with all applicable laws of South Africa, and we prohibit any use of this Digital Service that is contrary thereto.
- The SABC and its Users and/or Subscribers may not claim to own intellectual property or copyright to any text, video, image, audio, or other media content, including social media comments, public reviews, and submitted content, created by a User or external contributors (“User Generated Content”) and shared on SABC’s digital platforms.
- It is important to note that the SABC uses YOUTUBE for playback through integration for some of their content and it is important that Users and/or Subscribers familiarize themselves with Google Privacy Policy and YOUTUBE Terms of Services. Users and/or Subscribers agree that, by accessing YOUTUBE through any of the SABC’s Digital Services, they will be bound by the Google Privacy Policy and YOUTUBE Terms of Services.
- The SABC’s Digital Services utilizes the YouTube API Services to display public content from YouTube. By using our video features, the User and/or Subscriber agrees to the YouTube Terms of Service and Google Privacy Policy.
- Data We Fetch (Real-Time):
- We retrieve public YouTube data (titles, likes, thumbnails) solely to display videos and playlists.
- Data We Do NOT Collect:
- We do not collect personal viewer data (names, emails, watch history) or store any YouTube data permanently on our platforms.
- Cache Expiration (Refresh):
- To ensure fast loading and to comply with YouTube’s usage limits, the SABC’s API tool sets cache to expire after 1 (one) hour. When that hour is up, the next visitor to the page will trigger a new live API call to fetch the latest data (new videos, updated view counts, etc.). It does not call the YouTube API again until the cache expires.

- By using this Digital Service, the User and/or Subscriber represents and warrants they are 18 years of age or older and have the legal capacity to enter into a binding agreement. If the User and/or Subscriber are under the age of 18, the User and/or subscriber’s parent or legal guardian must use this Digital Service (Website or Mobile Application) on the User and/or Subscriber’s behalf and agree to these terms and conditions.
- The SABC and SABC News may have affiliations to third party organisations. The User and/or Subscriber acknowledges that third party organisations have their own Terms and Conditions with which the User and/or Subscriber agrees to familiarize themselves.
- We do not warrant nor guarantee the accuracy of the information on this Digital Service (Website or Mobile Application)and hereby advise the User and/or Subscriber that our services are rendered “as is” and we shall not be held liable for any inaccuracies or any losses of whatsoever nature. We encourage the User and/or Subscriber to take steps to verify all information before relying on it.
- All personal information we acquire when a User and/or Subscriber uses this SABC News Digital Service (Website or Mobile Application)or uses a link to a third party website/Digital Platform/Mobile Application shall be dealt with in accordance with the Protection of Personal Information Act No. 4 of 2013 “POPIA” as further detailed in our Privacy Policy.
- Any breach of these Terms and Conditions of Service by the User and/or Subscriber shall be borne entirely by the User and/or Subscriber. We shall not be liable for any losses, damages or injuries caused by or arising from the conduct of the User and/or Subscriber.
- The SABC is the owner and/or authorised user of all content, trademarks, material, copyrights and all other intellectual property appearing on or contained within this Digital Service (Website or Mobile Application), and such intellectual property remains the exclusive property of the SABC, unless indicated otherwise. Except as provided in these Terms and Conditions of Service, use of this Digital Platform/website/mobile application does not grant the User and/or Subscriber any right, title, interest or license to any such intellectual property that may be accessed except as provided.
- The User and/or Subscriber shall neither use nor permit the use, directly or indirectly, of the content for dubbing, copying and recording.
- All other rights in and to the content, including, without limitation, all copyright and other intellectual property rights relating to the programmes, are fully retained by the SABC.
- These Terms and Conditions of Service shall be governed by the laws of the Republic of South Africa and the User and/or Subscriber consents to the jurisdiction.
