Court to rule on Selebano’s Esidimeni subpoena on Wednesday

Suspended Gauteng Health Department Head Dr Barney Selebano’s urgent application to challenge his subpoena to appear at the Esidimeni Abitration hearings has been moved to Wednesday.

He approached the High Court in Johannesburg to have the subpoena set aside pending the finalisation of his internal disciplinary hearing.

Selebano is one of three senior health officials who have been fingered as the key decision-makers in transfering over 1400 mentally-ill patients from Life Esidimeni. 143 of them died at unlawful and ill-equipped NGO’s.

Selebano is said to have been the second in command on the project. The Health Ombudsman has already found that he had played a big part throughout the project.

Several witnesses, including the suspended Mental Health Director, have implicated Selebano.

He recently lost his appeal on the Ombudsman’s findings.

Selebano is due to take the stand at the Arbitration hearings next Monday, but he fears that he might incriminate himself.

The state is opposing the application.
