The Middelburg Specialised Commercial Crimes Court in Mpumalanga has struck the R2.8 billion fraud and corruption case against former Eskom’s Chief Executive Officer Matshela Koko and 18 others off the roll.

Koko and his co-accused were arrested last year and charged with corruption in relation to the construction of the Kusile Power Station, near Emalahleni.

Magistrate Stanley Jacobs finds there has been undue delay in fraud and corruption case.

‘Hate crime’

Reacting to the decision by the court, Koko says what the National Prosecuting Authority (NPA) has done to him and his family can only be described as a “hate crime”.

He was speaking to the media outside the court.

“Justice cuts both ways. There are serious allegations made by the state against me, the public expects that these allegations must be answered. I think we’re taking South Africans for a ride. The NPA is doing South Africans a big disservice. You can’t make such allegations, investigate them for more than 5 years, bring me to court, wake me up at six in the morning, and more than 12 months later you’re not ready to go to trial. What we see here is hate crime.”
