Court rules against disgruntled E Cape ANC members

The nine ANC members whose application was dismissed with costs in the High Court in Grahamstown are to seek leave to appeal.

The group had sought to challenge the legitimacy of the current provincial executive committee.

The PEC was elected in a chaotic conference in East London in September.

The group alleged that many delegates left and only a faction that supports Oscar Mabuyane voted.

Handing down the judgment, Judge Thembekile Malusi said the respondents would only pay costs relating to the filing of the supplementary affidavit and all other costs will be incurred by the applicants.

Legal representative for the respondents, Ngqiqo Sakhela, says they welcome the judgment.

The applicants have indicated they’ll appeal the decision.
