Breytenbach mulls over malicious prosecution

Former senior prosecutor and Democratic Alliance (DA) Member of Parliament (MP)  Glynnis Breytenbach says she and her lawyer Gerhard Wagenaar are weighing their options on whether to file a lawsuit for malicious prosecution.

This comes after the two were acquitted of charges of contravening the National Prosecuting Authority (NPA) Act and defeating the ends of Justice.

The Pretoria North Magistrate’s Court found them not guilty of the charges brought against them by the NPA.

Breytenbach explains who will be sued if they continue with the lawsuit.

“Certainly it will be against the National Prosecuting Authority and in all probability if we proceed and we may or may not. In all probability it will be against the persons who took the decision to prosecute on the basis of very scant evidence in their person capacities.”
