Ad-hoc committee investigating Mkhwebane’s fitness to hold office expects to finalise its report next year

The Ad-hoc committee probing the fitness to hold office by Public Protector, advocate Busisiwe Mkhwebane, expects to finalise its report in mid-January 2022.

The committee is investigating two counts of misconduct and incompetence against Mkhwebane. This after an independent panel of experts found that there was a prima facie case against the public protector.

The committee intends to undertake the process as fair and rational. The committee was established following a motion by the DA.

Parliament then adopted the rules for the removal of a head of a Chapter 9 Institution.

However, Mkhwebane unsuccessfully tried to interdict the implementation of the rules and now she is challenging the bid to remove her from office on constitutional grounds.

A judgment on that case is pending.

Parliament says the enquiry will allow for limited public participation and only those with facts will be allowed representation. Mkhwebane will be given a right of reply as well as commenting on the draft report before it is adopted.

The committee says it will use an external initiator and internal expertise to undertake the enquiry.

The committee will meet again next week.
