Fishing company loses Constitutional Court bid

The Constitutional Court

The Constitutional Court rules in favour of the government

March 12, 2004, 12:15

The Constitutional Court has dismissed an application with costs by a Cape Town based fishing company against the government's allocation of fishing quotas. Bato Fishing, a consortium, was unhappy with the allocation of quotas by Valli Moosa, the environmental minister.

Bato Fisheries applied for 12 000 tonnes in the deep sea hake trawler sector, but was allocated 873 tonnes. The company first took the matter to the Cape High Court and won the case.

The Appeal Court later overturned the High Court ruling in favour of the government.
