Lawyers of the former head of the Fidentia group of companies, J Arthur Brown, will file an urgent application in the Cape High Court today. Their intention is to force the State to give them the affidavit that they used to secure a warrant of arrest for Brown.
Brown is facing new charges of theft and money laundering amounting to more than R1 million. He was arrested last Friday. Brown's lawyer, Rashaad Khan, says they are still busy drafting papers to be presented before court. Khan says that the National Prosecuting Authority (NPA) has agreed with Brown not to execute the warrant issued on the April 3.
He says the NPA has also agreed to withdraw the warrant issued for Brown's wife, Susan. Khan says they need to get the affidavit in order to approach the Cape Town Magistrate's Court to set aside both the warrants issued for the Brown couple.
Meanwhile Brown remains under medical observation at a private hospital after he was assaulted by other awaiting prisoners en route to Pollsmoor Prison on Monday.
