Former Fidentia boss and his wife continue their fight for their assets
|
January 15, 2008, 11:45
Former Fidentia boss, J Arthur Brown and his wife Susan are to launch an application for leave to appeal the provisional sequestration order granted against their joint estate by the Cape High Court last month.
On December 4, Judge Dennis Davis set Tuesday January 15 as the return date pertaining to the provisional sequestration order.
Today, the matter was first on the court roll before Judge Abie Motala but it was stood down to enable the legal teams to approach Davis in chambers.
The purpose of today's proceedings was for Brown to oppose the confirmation of the liquidation. Had Brown and his wife failed to oppose it, the sequestration would have been declared final.
Instead, their legal team chose to appeal the provisional order, but they first have to apply for permission to appeal. Their application for leave to appeal is to be heard on Monday, January 21. - Sapa
