Selebi plans to stop the NPA from prosecuting him

The National Prosecuting Authority (NPA) says there is no basis for National Police Commissioner Jackie Selebi's court challenge against them.
Selebi's lawyers have filed their notice of motion for an urgent application against the prosecutions body at the Pretoria High Court tomorrow.
According to the notice, Selebi will ask the court to interdict the NPA from proceeding with any criminal prosecution against him. He will also ask the court to set aside any possible warrant for his arrest.
“The NPA intends to go to court tomorrow to oppose the application. We feel that there isn't really a basis for this application to be made. However, we are reluctant to pronounce further on the matter. We are saying that we will have our day in court where we advance our arguments,” says NPA spokesperson Tlali Tlali.
Events prior to Selebi going to court
On September 27, 2005 mining tycoon Brett Kebble was fatally shot. Ninety minutes after the hit on Kebble, one of his associates, Glenn Agliotti, allegedly phoned Selebi.
In May 2006, the former Group Executive of the Airport Company of South Africa, Paul O'Sullivan, publicly launched a scathing attack against Selebi. His dossier detailed the involvement of senior police officials in organised crime.
The NPA refuted claims that it is investigating Selebi. It then raided Agliotti's home and business. A diary, which lists appointments with Selebi, was seized.
In November of the same year, Agliotti was arrested in connection with Kebble's murder.
In September 2007, the NPA obtained a warrant of arrest for Selebi. Later that month, NPA boss Vusi Pikoli was suspended. Selebi's warrant was withdrawn.
The following month, a task team was set up to review a criminal probe against Selebi.
Two days ago, top Scorpions prosecutor Gerrie Nel was arrested. It was Nel who obtained an arrest warrant for Selebi in September.
