UDM welcomes NPA court judgement

United Democratic Movement Leader Bantu Holomisa has welcomed the judgement. Holomisa says a new NPA head who will do the job without fear or favour should be appointed soon.

The High Court in Pretoria has ruled that Deputy President Cyril Ramaphosa has 60 days to appoint a new National Director of Public Prosecutions (NDPP), because President Jacob Zuma is too conflicted to appoint a new NDPP.

The court has set aside Shaun Abrahams’ appointment as NDPP and declared the position vacant.

A full bench of judges has also declared invalid the R17 million golden hand shake granted to the former NDPP, Mxolisi Nxasana, who has to pay back the money.

Handing down judgement, Judge Dunstan Mlambo referred to the many criminal charges against President Zuma and made it clear he cannot appoint the next NPA chief.

“It is declared that in terms of section 96(2) b the incumbent president may not appoint, suspend or remove the NDPP or someone in an acting capacity as such. Eight, it is declared that as long as the incumbent president is in the office, the deputy-president is responsible for decisions relating to the appointment, suspension or removal of the NDPP or someone in an acting capacity as such.”
