Majority judgment rules in favour of Vela Shembe

The majority judgment in the Nazareth Baptist Church leadership battle  at the Pietermaritzburg High Court has upheld a judgment by Durban High Court Judge Achmed Jappie in the leadership matter.

This after Mduduzi Shembe appealed the decision by the Durban High Court declaring Vela Shembe as the rightful leader.

Vela Shembe died shortly after the High Court judgment last year in November.

He won after two of the three judges dismissed evidence by the eBuhleni faction.

Judges Jerome Mnguni and Thoba Poyo-Dlwathi said in their judgment there was never an oral nomination, where late leader Vimbeni Shembe had nominated his son Mduduzi Shembe.

They say this was fabricated and should not be taken as truthful by the court.

However, a minority judgment by Judge Isaac Madondo suggests that both leaders were nominated – and that the church’s executive committee should hold a secret ballot to choose between them.
