Law unclear on whether black people can be racist: HRC

The Human Rights Commission says it’s still not clear whether or not black people can be racist towards other race groups in the country but the debate on the matter is still on-going.

Spokesperson, Gushwell Brooks says the law is not distinctly clear about the matter.

He however says there are incidents reported to the commission by white South Africans who feel they have been racially attacked by their black counterparts.

His comment follows a few incidents of race that have sparked an outcry throughout the country, including the sentencing of former Real Estate Agent, Ricki Momberg.

On Thursday a group of white people went down on Gauteng MEC for Education, Panyaza Lesufi, saying his is raping their Afrikaans language due to his new regulations on langauages in schools.

Brooks says: “When someone comes to the SA Human Rights Commission and says as a white person – a black person has been racist towards them – we not going to turn them away and say there is still a very interesting debate on the matter on whether black people can be racist or not.”

“It’s a legal issue and its clear cut in that instance, based on equality as a starting point, then of course what is the conduct and what was said, that’s what we have to view and if it was racist it was racist,” says Brooks.
