Family disappointed by court judgement in pit toilet case

Section 27’s Education Attorney, Sheniece Linderboom, says the family of the late Michael Komape are very disappointed with Monday’s Polokwane High Court judgement.

The Court dismissed a R3 million claim for damages by the family of deceased learner.

The five-year-old, fell to his death into a pit toilet at Mahlodumela Primary School, outside Polokwane in 2014.

Section 27 helped the family with the case and Linderboom says its shocking that the court dismissed the claims even though the state had admitted liability.

In a ruling that took under five minutes, the judge did not provide reasons for dismissing the claim.

The court did however order structural changes.

The court said also that the Department of Basic Education should give the court a plan on how, and when, they plan to address the toilet issues in schools.

Linderboom says: “We are hopeful that the toilet problems will be sorted especially now that it will be supervised by the court.”
