DA to oppose President Zuma’s application

The Democratic Alliance says it will oppose President Jacob Zuma’s application for leave to appeal the High Court’s State Capture ruling.

President Zuma is challenging the ruling given earlier this month that he is too conflicted to appoint a judge to head the commission of inquiry into state capture and that the Chief Justice must rather make the appointment.

Zuma is basing his objection on 20 grounds, including the doctrine of separation of powers.

The DA’s James Selfe says the President’s grounds are flimsy.

A long standing principle in our law that you cannot be a judge in your own matter, an extension of that you cannot choose the judge in your own matter.

“I have no doubt if the President was given a free hand he would choose a judge with his line of thinking and sympathetic to him and that cannot be the case. Because then we will never get to the bottom of what is involved in State Capture that is bleeding our country dry.”

The Economic Freedom Fighters (EFF) says President Zuma’s latest court action seeking leave to appeal the High Court State Capture ruling is merely a delay tactic.

President Zuma has filed papers arguing that the court erred when it ruled to uphold the Public Protector’s State of Capture remedial action and recommendations.

The EFF’s spokesperson, Mbuyiseni Ndlozi says President Zuma is just buying time in order to evade the State Capture probe.
