Election commentators and media have been divided over the question of who is ultimately responsible for ensuring free and fair elections in South Africa.
But Terry Tselane, former IEC Commissioner and a member of the SABC’s team of Election Analysts has confirmed to SABC News that Section 182 of the Constitution stipulates the responsibility sits with the IEC.
He states that sub-section 190 of Section 182 makes the IEC’s duties clear in all the major elections processes.
