Cape Town nightclubs gang appear for a bail hearing

Lawyers of the five men accused of intimidating and extorting restaurant and nightclub owners in Cape Town say further delays in their bail application amount to an infringement of their human rights.

Nafiz Modack, Colin Booysen and three others were arrested in connection with the alleged violent takeover of nightclub security in December.

The matter was postponed again on Wednesday due to the investigating officer falling ill.

The state told the court the investigating officer, Charl Kinnear, suffered chest pains on his way to court and is seeing a doctor. Kinnear is under cross examination by lawyers of the five accused.

The state is opposing bail saying the accused might interfere with witnesses.

The state also says they are facing serious crimes.

The lawyers for the five men say their clients are prejudiced by their long stay in prison because they are unable to earn an income. Others say they cannot access their life saving medications.

The five allegedly terrorised businesses in what is believed to be turf wars in the Cape Town nightclub scene.

They allegedly demanded payments of up to R90 000 per month per business to provide security.

During his testimony on Wednesday, investigating officer Charl Kinnear told the court that Modack and Cronje would be charged for last year’s murder of a bouncer at the Cubana nightclub in Green Point.

Magistrate Joe Magele granted the postponement.

The matter will return to court next Wednesday.
