Two of South Africa's top legal eagles will go head to head in the crimen injuria trial of the Reitz Four in the Bloemfontein Magistrate's court tomorrow.
Senior Advocate Kemp J Kemp who defended President Jacob Zuma will lead the defence. The State has called in Senior Advocate Johan Kruger to lead the prosecuting team. He represented the Waterkloof Four.
Former Free State University students - RC Malherbe, Johnny Roberts, Schalk van der Merwe and Danie Grobler, are accused of humiliating five university employees after they shot a video opposing the university's integration policy. The video shows five black university employees participating in a mock initiation. They are fed food which appears to have been urinated upon by one of the students.
A crimen injuria case is usually not regarded as of such importance, but the incident generated world wide interest.
"The case has taken such huge dimensions, stirring up feelings. It is very difficult, the court will have to decide how serious are the feelings of the people, whether they have been hurt. On the other hand the students would to say that they consented and that they did not mean it and they will argue that they did not want to create this injury," says legal expert, Marinus Wiechers.
In the spirit of reconciliation, the university last year dropped internal disciplinary charges against two men who were still students when the video went public. They were invited back to finish their studies but declined. The other two had already completed their studies.
A civil case in which the workers demand R1 million each, as compensation will be heard at a later stage in the Equality Court.
